It is a commonplace to suggest that Britain deals with cold weather worse than its continental neighbours. Trains don’t work, people grumble and air travel becomes a bit of a nightmare. People slide all over the place on untreated pavements and the media are delighted that they have something to fill their screens and pages. Climate change deniers are also pleased and the whole situation has something farcical about it.

It is possible that amidst the comedy, a tragedy can occur. An elderly person can suffer a severe personal injury. A road traffic accident can leave several people maimed. A child can fall off a bicycle on an untreated surface and be left with a disability. Whether compensation claims are likely to prove successful depends on the circumstances in which a specific personal injury is sustained. However, it is not only the circumstances that determine the outcomes of particular compensation claims. The British weather remains highly unpredictable. Cold spells can affect different parts of the country over extended periods of time.
