£8 million compensation payout bill prompts appeal

A court decision surrounding compensation claims has sparked an appeal by the Catholic Church. As reported in the Northern Echo, a judge had decided that the Diocese of Middlesbrough was responsible for providing £8 million in relation to compensation claims made by victims of a child abuse scandal.

The abuse had gone on for three decades. Alleged physical and sexual mistreatment affected up to 142 people. It is alleged to have occurred at St William’s Community Home, situated in the vicinity of York. One alleged victim of the possible mistreatment, Mr Baverstock, has encouraged others to speak out about the abuse he contends was inflicted on him and others.

The case of possibly massive abuse resulted in the largest ever abuse-related compensation claims made against the Catholic Church. Between 1962 and 1992, boys were taken in from local authorities in the area – about 2000 boys went through the (more…)

Unspecified compensation payout for disabled child

Stephen Loraine is 9 and needs a lifetime of care after he was deprived of oxygen in his mother’s womb. As reported in the Liverpool Echo, he has recently obtained a large amount of compensation from the hospital concerned.

It would appear that Arrowe Park hospital on the Wirral failed to pay proper attention to the medical records of Pauline Lorraine. She had a “fibroid” which should have set alarm bells ringing. Compensation payout following asbestos death

Alan Bickle was 58 when he died of mesothelioma, a condition connected to exposure to asbestos. As reported in the Jarrow and Hebburn Gazette, Mr Bickle had worked with the substance in a factory run by Filtrona. He died in January 2009, some years after working in the factory in Jarrow.

Mr Bickle left a widow when he died. June Bickle was devastated by the death of her husband. She is to obtain £50,000 in compensation as a partial settlement in the aftermath of a High Court decision, while the total compensation payout is calculated. Compensation claims caused by pot-holes to be reduced?

As reported in the Gloucestershire Echo and other media recently, Gloucestershire Highways has begun a quest to deal with some of the many thousands of potholes which make driving in the area dangerous. The problem has been exacerbated by the spell of cold weather that occurred during the festive season.

However, the Health and Safety Executive has made it clear that employees have considerable obligations with regards to complying with the relevant regulations. Are RIPA laws a proportionate response to a false personal injury claim?

Nobody would defend people who commit petty fraud, but Henry Porter and Afua Hirsch are very concerned about the use of RIPA (Regulation of Investigatory Powers Act) laws by local authorities. These surveillance laws were introduced to protect us from serious crime and terrorist activity. However, campaigners who stand up for civil liberties believe they are no longer being used as they were originally intended.

Journalists at the Lancashire Evening Post made a Freedom of Information Request in relation to how Lancashire County Council was using RIPA laws. They discovered that intrusive surveillance techniques were being adopted to check on the travel expenses of a care assistant, for example. A journalist reported:

Fraudulent whiplash claims

The cost of car insurance has been increasing recently and providers of car insurance are complaining that insurance fraud and whiplash claims are compelling them to make motor cover more costly. It is increasingly important that we distinguish between fraud and legitimate claims.

The Automobile Association (AA) has claimed that it is struggling to make a profit through its insurance arm. For example, Simon Douglas, Director of AA Insurance, told The Times that British drivers were more likely to make whiplash claims than in the past. Mr Douglas stated:
