The family of a man killed in a road traffic accident has been awarded a compensation sum of £350,000.
Ninian Donald, 33, was cycling home from work when he was involved in a collision with a skip lorry. He is survived by his long term partner, Kate Evenden, and a 19 month old daughter, Rosie.
His partner Kate had to take the matter to London’s High Court, however, to make a compensation claim when CCTV footage revealed that Mr Donald was partly at fault for the accident and his death.
The footage showed that Donald, who worked in Hackney, took to the pavement before re entering road traffic and ended up in close quarters with the lorry, where he collided with it and was dragged under its wheels when the lorry made a left turn across a bus lane.
Injury solicitors, whilst arguing that the lorry driver was at fault, did accept that Mr Donald was partly to blame and admitted that he was 25% at fault for the incident. That being said they claimed that the driver’s wing mirror was not properly adjusted to allow for full view of the road and other road users, resulting in the driver taking the majority of the blame for the accident.
The High Court ruled in favour of Kate and awarded damages of £337,500 to Miss Evenden, and £25,000 to their daughter Rosie, who will receive the money when she turns eighteen.
