Making a Whiplash Claim

Whiplash can be a serious injury that can continue to cause problems for many years. Symptoms can include headaches, shoulder and back pain and neck stiffness. Most symptoms last short term but many people continue to feel discomfort longer term.

Whiplash injuries are in the main caused from road traffic accidents when the body is jerked forward. The injury should be checked out, which usually requires an x-ray being taken to check for any damage to the spine.

According to the Association of British Insurers (ABI) the number of people with cause to make a whiplash claim has increased by 25% over the last five years. Protection against whiplash can be doing something as simple as ensuring that your headrest is adjusted correctly. The top of your head should be level with the top of your head restraint and the restraint should be as close to your head as possible. The ABI’s publication ‘Tackling Whiplash Prevention, Care, Compensation’ also suggests other preventative measures include improving driver behaviour. Whiplash is most commonly caused by tailgating. Those driving for work are particularly prone to tailgate: 61% of at-work drivers admitted to tailgating, compared to 40% of other drivers.

When making a Whiplash claim a medical report will be required, your solicitor will request your medical report from your hospital check from after the accident and then arrange for you to visit a medical expert, you will then undertake a full medical examination. The medical expert will then report back their findings to your solicitor.
