A woman has been forced to drop her compensation claim against the NHS after her son was born with cerebral palsy. Franzi Phillips’ son, Cristian, was born in Pembury Hospital in Tunbridge Wells in 1999 with the cerebral palsy condition. Miss Phillips her son was born with the condition due to a lack of care and monitoring from the hospital during his birth. She claims that the drug ‘Syntocinon’ was administered to her in error.
Miss Syntocinon Phillips’ lawyers stated that she had a claim for compensation and they believed she could win as much as £300,000 from the NHS. However, as the case progressed over the last nine years it has emerged that there isn’t enough evidence to prove liability on the part of the hospital.
Ms Phillips stated:
I feel devastated for Cristian. We thought we would receive some compensation for him.
It has been a struggle over the years and we have been hoping and praying that everything goes well.
It’s so unfortunate that all this work has been done, but I must keep going. Generally I am a very positive person and I am hoping his future will be provided for.
Obviously I feel very upset, frustrated and let down, but I have to believe Cristian will get the help he needs.
Miss Philips is now raising her disabled son on her own, and even set up a support group for parents with disabled children in 2006.
