Personal Injury, Compensation Claims And Your Right To Claim

Nobody should suffer physically or mentally from the negligence of others. Therefore, it is correct that compensation for physical or mental trauma should be the right of every individual. The law has recognised this since the famous case of May Donahue, who successfully sued Stephenson’s ginger beer makers, of Glasgow for damages way back in 1928.

May Donahue was aghast to find the remains of a snail in a bottle of ginger beer she had purchased and, unfortunately, drunk from. The judge supported her claim advising that the company had a duty of care to its customers and ordered that May Donahue should be awarded compensation for her suffering.

From minor injuries such as whiplash through to the devastating effects of mesothelioma, a cancer caused by the inhalation of asbestos and without any cure, everybody has the right of address.

Why An Accident At Work Should Not Be Ignored

Constantly improved and monitored health and safety regulations have rendered an accident at work a far less likely occurrence than in days gone by. However, accidents in the workplace do happen and far more than are realised so an employee needs to be armed with practical knowledge to react in such an event.

There are various causes that bring about an accident at work; sometimes the employee is at fault but often it is the employer who has failed to integrate the required safeguard procedures. It is the employee’s responsibility, however, to provide evidence of negligence and they are obliged to ensure that the employer is fully aware of the accident.

Employees are also legally obliged to report any major accident at work, including major injuries, dangerous occurrences and work-related ailments. As victims of such an accident, their options are to sit back and collect the (more…)

Changes to claims process will benefit 500,000 people

Changes to the way that personal injury claims are made in road traffic accidents come into effect at the end of April 2010. The main changes, made by the Ministry of Justice, are designed to reduce the time that it takes for disputes to be settled. The idea is that this will be achieved by setting fixed time limits and costs for less complicated accidents.

Steps to make this change were made after the government consulted a number of representatives from different claimants and insurers. The focus of this change is based on one of the main strategic objectives of the Ministry of Justice, which is to:

“Provide fair and simple routes to civil and family justice.”

Most bizarre accident claims revealed

An article published on the Daily Telegraph’s website this week has revealed some of the most bizarre compensation claims that have resulted in payouts from UK councils.

Among the accident claims submitted are a £3.95 compensation sum paid to a person by Barnet council for ‘damage to trousers as a result of dry cleaning’, along with a ten pound payout to somebody that hit their head on a low sign.

The data, which was uncovered as the result of a Freedom of Information request, also showed examples of a council in Canterbury paying twenty pounds to a person for damage sustained to their shoe, or Aberdeenshire compensation claims to the tune of eight pounds for an unexplained ‘grass cutting incident’.

Other minor common minor claims included small sums for bruises and grazes as a result of falling over (more…)
