Cyclist proves mystery farmer was negligent

In a challenging case, a cyclist from Lancashire was awarded £2,000 in damages for personal injuries he received when he lost control of his bike on oil spilt by a farmer. Lawyers successfully appealed against an earlier decision not to award his compensation claim.

When he fell from his bike, near Garstang in Lancashire in June 2007, forty-two year old Antony Di Domenico suffered extensive injuries and stress. The injuries took some weeks to heal and he was left with persistent muscular pain.

A witness to the cycling accident reported that the oil on the road was due to the actions of a farmer, who was observed to then pour sand over the spillage to lessen the hazard. One Million Payout for Solicitor

A Hampshire woman has been awarded nearly £1,000,000 in damages following injuries sustained in a car accident.

Ms Estelle Clarke, a high-flying lawyer, was compensated for her head injuries which resulted in continued post traumatic stress and further psychiatric problems forcing Ms Clarke to abandon her successful career at a London based legal firm.

Ms Clarke had been a passenger in her partner’s car when he collided into another car being driven by Karen Hobbs.

Mrs Hobbs, a young mother who worked as an estate agent, died at the scene of the crash. Her family only received £15,000 compensation following her death.

Ms Clarke’s compensation payout has caused some controversy with some readers of the Hampshire local newspaper, The Daily Echo, claiming that the payout figure is “shocking” when compared to the payout received by the Hobbs family. One reader suggested that (more…)

Changes to claims process will benefit 500,000 people

Changes to the way that personal injury claims are made in road traffic accidents come into effect at the end of April 2010. The main changes, made by the Ministry of Justice, are designed to reduce the time that it takes for disputes to be settled. The idea is that this will be achieved by setting fixed time limits and costs for less complicated accidents.

Steps to make this change were made after the government consulted a number of representatives from different claimants and insurers. The focus of this change is based on one of the main strategic objectives of the Ministry of Justice, which is to:

“Provide fair and simple routes to civil and family justice.”

False insurance claims rising

 

New research by an insurance company has revealed that fraudulent accident claims are on the rise as a result of the current difficult economic climate.

The research, carried out by LV, has unveiled that four in ten solicitors have experienced questionable insurance claims since the UK entered an economic recession, as many households struggle to make ends meet in the event of pay freezes and redundancies. Over half the false claims submitted related to a road traffic accident, where the supposed victim exaggerated injuries in order to make a whiplash claim or similar health condition related payout.

Weather related compensation claims top £650 million

New research by the Association of British Insurers (ABI) has revealed that insurers have been forced to pay out more than 650 million pounds over the winter in accident claims due to the extreme winter weather conditions.

According to the BBC website, between 18 December 2009 and 13 January 2010, British insurance companies have paid a multi-million pound sum to UK residents for damage caused to their cars, homes and businesses due to the ice and snow that affected large parts of the country.

The most common form of accident claims that resulted in payment were caused by road traffic accident cases in which vehicles were damaged and personal injuries occurred from crashes on icy roads. Footballer makes personal injury claim against FA

As reported earlier this week, former West Ham footballer Dean Ashton is set to make a personal injury compensation claim against the Football Association (FA) following an ankle wound that ended his footballing career in 2009.

Ashton is claiming that the FA is responsible for vicarious liability for the personal injury, which occurred during a tackle in an England training session in 2006 between himself and Manchester City right winger Sean Wright Phillips (who played for Chelsea at the time) and resulted in the 26-year-old becoming forced to end his professional sporting career.

Dean was 18 months into a five month contract for the London-based club at the time of suffering his personal injury, and West Ham subsequently paid him out of his legal tie with a year’s salary. This amounted to more than (more…)
