Why claiming for personal injury is right

Personal injury claims have developed something of a negative press over the last few years. They are perceived in the media as people trying to get money that is not owed to them, and unscrupulous personal injury lawyers are profiting from it.

However that’s not the case at all. When you suffer an injury and someone is to blame for the injury, you deserve to receive compensation for your injuries. Why should you be out of pocket because of something that was not your fault?

Claiming personal injury compensation is just and right because it is money that owed to you. You could be claiming compensation for a number of different things, without which you could find yourself at a financial loss.

For example, you could be claiming for:

  • Medical expenses incurred because of your injuries
  • Damage to property, such as a vehicle
  • Hire of a courtesy car while your car is being repaired
  • Loss of earnings if you are unable to work (if you are self employed this is crucial)
  • Compensation for your suffering and pain

All of these are legitimate expenses that you should be paid for when you suffer an injury due to someone else’s fault.

Does Britain have a compensation culture?

Personal injury claims are becoming more widespread in today’s culture, with the option to claim compensation following an accident becoming far more accessible. Whether it is an accident at work or a road traffic accident, compensation claims have become a popular option for those who may be losing out at work due to injury or who have medical bills to pay.

In this age of health and safety paranoia, we are inundated with claims firms every time we open a newspaper or turn on the television. Reports from the BBC claim that this “compensation culture” costs the UK £6.8bn a year in payouts and legal fees.

From the point of view of those on the receiving end, the ability to claim compensation for an accident can be a godsend. These are people who may be missing out on monetary reward due to an inability to work, or who have medical bills to pay. Sometimes, their only way to stay on top of things is to claim compensation.

Surely, if you are injured, through no fault of your own, it is only fair that you are able to receive some form of recompense – some way for the guilty party who has caused your accident to make up for their carelessness? Of course, there are always those who try to abuse the system with false claims, and they’re the ones who give the genuine claimants a bad name, and encourage the image of Britain as a “compensation nation”.

Fraudulent claim admitted by Northern Ireland man

_45694347_metrobus203.jpgA man from Northern Ireland has admitted that he had made a fraudulent claim for personal injury compensation following a bus crash. Fifty eight year old Brian Langford admitted in court that not only was he not injured in the crash, but he wasn’t even on the bus at the time of the accident.

The bus company, Translink, was successful in defending itself against Mr Langford’s attempt to gain injury compensation.

Mr Langford withdrew his claim for personal injury compensation, but Translink wanted to prosecute him for his fraudulent attempts to extort money from them. As a result of the ruling, Mr Landford had to pay the legal bill for Translink, which amounted to £2,700.

Mr Langford initially claimed that he was injured in the bus crash in 2006, but after viewing CCTV evidence, Translink discovered that he was not even on board at the time of the crash.

Mr Langford could now also face community service for his efforts to claim personal injury compensation.

What can you be compensated for following an injury?

Should I claim for compensation following an accident?

Some people wonder whether they should file a compensation claim following an accident, such as a car accident or an accident at work. They believe that profiting from the accident isn’t just and that they should get on with their lives and put the incident behind them.

However, what about the injuries you have suffered? If you have missed work through your injuries, have suffered serious pain, have had the inconvenience of putting your life on hold and seeing a doctor then you deserve to be compensated. You also have a moral obligation to ensure that the pain you have suffered doesn’t happen to anyone else.

For example, if you suffer an accident at work and make light of the incident your employer may not take the necessary steps to ensure that your place of work is safe. This means that someone else could befall the same accident that you have suffered, possibly even hurting themselves more severely that you have done. There could even be a fatal accident at work as a result of you not making a claim for compensation against your employer, and that is something you would not want to live with.

You deserve to be compensated for accidents and you should also do your best to make sure those accidents don’t happen again.

Woman receives £750 compensation for discrimination

Mihaela_Popa_2_1488795cA Romanian woman who worked as an accountant for PricewaterhouseCoopers made a £40,000,000 compensation claim against her former employers after she claimed she was given an unfair reference following her resigning from work.

She claimed that the London firm treated her like a prostitute, forcing her to quit her job. However, she has been awarded just £750 in compensation for her trouble.

The tribunal found that she was indeed given an unfair reference by PricewaterhouseCoopers after she resigned in 2006, although they also ruled that her unfair reference was an isolated incident and she had not been mistreated during her time with the firm.

The panel ruled that the unfair reference didn’t impede her financially or in her career as she went on to land another, more lucrative, job.

We find that in no way whatsoever did the unlawful victimisation either prevent Miss Popa obtaining employment or cause her to lose employment.

There is no loss of chance in this case. This is simply a case of injury to feelings.

In the circumstances, we take the view that we are looking at an isolated incident of victimisation or retaliation.
