Why it’s important to seek medical attention after an accident

Categories: Compensation Claim | Tags: , , | Written by Hilary on September 25, 2009

Whenever you suffer any sort of accident you should seek medical attention for your injuries. You never know just how badly injured you may be, or how the symptoms can affect you later, so the advice and consultancy of a doctor is essential following an accident.

This is especially true when any head injuries have occurred. You may become tired, groggy or nauseas afterwards and this could be a sign of serious injury.

It’s also important to seek the advice of the doctor following an accident because this will add validity to any claim you make for compensation. When you contact a personal injury lawyer to discuss whether you may be liable to claim for compensation, one of the first things they’ll ask is if you attended the hospital following the accident. They will be able to use the report from the doctor as evidence in your case, which increases your chances of receiving a compensation payout from the insurance company of the guilty party.

Welsh hospitals warned about offering claims advice

_46379913_adNHS hospitals in Wales have been warned about offering free advice to patients on claiming compensation for their injuries. The health minister has instructed the NHS hospitals to stop offering the advice, via the leaflet pictured.

Health minister Edwina Hart claimed that the actions of the Welsh NHS hospitals in promoting the services of personal injury lawyers was inappropriate. However, the adverts are still on display in Cardiff advertising the services of personal injury lawyers in Cardiff.

According to the Cardiff and Vale NHS Trust, the use of the leaflet advertising personal injury claims lawyers in Cardiff was an error.

Leanne Wood, from Plaid Cymru, stated:

The advertisement then featured details of a company which provided help in claiming compensation for a variety of incidents including road traffic accidents, a slip or trip or accidents at work.

But it seems rather odd to me that the Cardiff and Vale NHS Trust should allow advertising along these lines when it could potentially lead to claims against hospitals and encourages the compensation culture.

I noticed in the trust’s annual accounts for 2008-09, that the trust set aside £3.2m as potential liabilities for personal injury claims.

Edwina Hart says that she contacted all NHS organisations in 2008 and requested that the leaflets were no longer used and that personal injury lawyers’ services were not advertised in hospitals.

A spokesperson for Cardiff and Vale NHS Trust claimed that the leaflets were removed but one had remained in error:

The trust fully supports the withdrawal of all patient information leaflets featuring adverts for personal injury lawyers.

Regrettably, this was an occasion where an old leaflet was still in circulation and given to a patient.

Immediate checks are being carried out in all areas so that any leaflets featuring adverts for personal injury lawyers are removed and replaced as soon as possible.
