NHS to use no win no fee lawyers

The NHS has made a dramatic turnaround in its policy towards personal injury lawyers who use the no win no fee system. Despite constant derision and criticism of no win no fee personal injury lawyers, the NHS will now be using the same lawyers for its own purposes.

The NHS originally blamed the increase in companies offering no win no fee services for the rise in medical negligence cases brought against them. However, in a dramatic turnaround the NHS will now use no win no fee lawyers to regain money lost through fraudulent personal injury cases. No win no fee lawyers will be used by the NHS Counter Fraud Service.

According to recent figures, 50% of all cases filed against the NHS for compensation for medical negligence are via no win no fee personal injury lawyers. No win no fee means that the person filing the case doesn’t pay any legal costs if they’re unsuccessful with their case. This creates a ‘can’t lose’ scenario for people looking to earn compensation against the NHS.

The NHS Counter Fraud Service has now signed a deal with the personal injury law firm Capsticks in a bid to recoup money paid out in compensation. The NHS currently recoups around £6 million every year as a result of fraudulent compensation cases, though that figure should be much higher.

Personal injury lawyer sued for failing to file case in time

A couple from St. Louis, USA, are suing their personal injury lawyer after he failed to file their case for compensation in time, allowing the statue for limitations to expire meaning they could no longer claim for their car accident.

The couple, Kenneth Funk and his wife Laurine, were injured in a car accident in 2005. The accident was not their fault, as another man, Todd Kessler, crashed into the side of their car.

However, their personal injury lawyer, Jeffrey S. Hamel, didn’t gather the necessary documents in time to file the claim against Mr Kessler, and didn’t even tell the couple that he had failed to do so.

The law suit, brought by the couple against the personal injury lawyer, states:

But for Defendant Attorney’s negligence, as pleaded above, Plaintiff would have been successful and recovered monies in his personal injury claims against Kessler arising out of the September 19, 2005 crash.

The couple are looking for $100,000 in compensation from their former personal injury lawyer, a similar figure to that which they would have claimed had their case been filed in time.
