Why you should claim compensation for your injuries

Have you had an accident and feel you are owed compensation? Perhaps it was an accident at work and you don’t feel comfortable returning to work until there are new health and safety rules. According to a recent survey by Personal Injury Lawyers, 27 per cent of people injured every year are entitled to compensation claims, but only 13 per cent of these people actually put in a claim. Some people feel uncomfortable making claims for money, but it’s your right. Why should you lose money because you can’t return to work after an accident that wasn’t your fault? Why should you foot the bill for physiotherapy sessions due to whiplash?

There are many companies that specialise in personal injury claims that will offer you help and advice. Should I claim for compensation following an accident?

Some people wonder whether they should file a compensation claim following an accident, such as a car accident or an accident at work. They believe that profiting from the accident isn’t just and that they should get on with their lives and put the incident behind them.

However, what about the injuries you have suffered? If you have missed work through your injuries, have suffered serious pain, have had the inconvenience of putting your life on hold and seeing a doctor then you deserve to be compensated. You also have a moral obligation to ensure that the pain you have suffered doesn’t happen to anyone else.

For example, if you suffer an accident at work and make light of the incident your employer may not take the necessary steps to ensure that your place of work is safe. This means that someone else could befall the same accident that you have suffered, possibly even hurting themselves more severely that you have done. There could even be a fatal accident at work as a result of you not making a claim for compensation against your employer, and that is something you would not want to live with.

You deserve to be compensated for accidents and you should also do your best to make sure those accidents don’t happen again.

Woman receives £750 compensation for discrimination

Mihaela_Popa_2_1488795cA Romanian woman who worked as an accountant for PricewaterhouseCoopers made a £40,000,000 compensation claim against her former employers after she claimed she was given an unfair reference following her resigning from work.

She claimed that the London firm treated her like a prostitute, forcing her to quit her job. However, she has been awarded just £750 in compensation for her trouble.

The tribunal found that she was indeed given an unfair reference by PricewaterhouseCoopers after she resigned in 2006, although they also ruled that her unfair reference was an isolated incident and she had not been mistreated during her time with the firm.

The panel ruled that the unfair reference didn’t impede her financially or in her career as she went on to land another, more lucrative, job.

We find that in no way whatsoever did the unlawful victimisation either prevent Miss Popa obtaining employment or cause her to lose employment.

There is no loss of chance in this case. This is simply a case of injury to feelings.

In the circumstances, we take the view that we are looking at an isolated incident of victimisation or retaliation.

Miners told to avoid personal injury lawyers

A new law passed by the government came into effect this month allowing miners to claim for compensation for injuries suffered to their knees while at work. The injury is called osteoarthritis and is known to affect miners who worked in the pit for many years kneeling in damp and wet conditions.

From July 13th miners are able to claim for compensation by claiming Industrial Injuries Disablement Benefit.

However, miners have been advised to avoid using personal injury lawyers and no win no fee solicitors to pursue their claims. Instead they have been advised to use the Jobcentre Plus.

The Secretary of State for Work and Pensions, Yvette Cooper, added:

Man receives compensation for accident at work

 

A thirty-nine-year-old lighting attendant has received personal injury compensation after suffering a serious injury while he was at work. Ricky Bratton worked for Colas Limited at the time of the accident, March 2007. He was retrieving equipment from the back of his van in East Sussex when a car ploughed into him at speed.

Mr Bratton was pinned to the van by the car, which then sped off. However Mr Bratton and work colleague managed to catch the driver some distance down the road. After visiting the hospital Mr Bratton was found to have suffered bruising and missed three weeks of work.

Bomb victim to sue MOD for personal injury compensation

Forty-five-year-old Graham Hopps is to sue the Ministry of Defence after he was injured in a roadside bomb that exploded while he was working in Iraq. The Land Rover that Mr Hopps was in was hit by the blast, near Basra, causing Mr Hopps shoulder injuries.

He believes that he wasn’t protected sufficiently by the MoD and is pursuing them for compensation for injury. Mr Hopps, from Leeds, Yorkshire, was injured by the blast in 2003. He was working on a power station and was only given a Land Rover to make his journey on a route that he said was unapproved.

Accident at work investigated by Petroleum Safety Authority

An accident at work on the Deepsea Bergen left a man with crushing injuries. The incident was investigated by the Petroleum Safety Authority Norway, revealing that several health and safety regulations were not observed.

A man suffered crushing injuries to his chest while working on the drill platform. The crew were working on the grating on the top of the drill’s cabin when a man became trapped between the access platform and the railing. He was flown by helicopter the hospital. The following nonconformities were uncovered:

Deficient management, understanding of risk and risk assessment
Deficient planning, organisation and execution
Deficient communication
Deficient procedures and instructions
Deficient compliance with procedures and instructions

The police have asked the PSA for their assistance while they investigate the accident at work. The condition of the injured man is not known at this time.
